CHAPTER 7 BANKRUPTCY

CHAPTER 13 BANKRUPTCY

Individuals with regular income who are momentarily unable to pay their obligations and would like to pay them off over time in payments can file for bankruptcy under Chapter 13 protection. If the combined sum of your secured and unsecured debts falls within a range specified by the Bankruptcy Code, you may qualify for Chapter 13. You must submit a Plan to the Court outlining how you intend to use your future income to pay off all or a portion of your debts to creditors. Typically, the court will give you five years to pay back your obligations, but no less than three. As long as you keep paying your obligations under the Plan, you are free to keep all of your possessions, exempt and otherwise.

  • Chapter 13 prohibits litigation and repossessions while protecting your home from sheriff sales, foreclosures, and tax sales. 
  • The goal of Chapter 13 is to assist you in negotiating a more reasonable repayment schedule with your creditors. 
  • A court-appointed trustee will gather your monthly payment and distribute the funds to your creditors if the court approves your repayment plan, which might run from three to five years. 
  • The remaining balance of your unsecured debt can be dismissed once the repayment plan is finished.
